Shared Definitions

These definitions apply to the Terms and Conditions, Privacy Policy, Cookie Policy, Acceptable Use Policy, Community and Moderation Policy, Copyright and Takedown Policy, and Contact and Legal Notices. The ordinary meaning applies where context requires. The Terms govern contractual rights; the Privacy Policy governs our description of personal-data processing. Neither limits statutory rights.

Account means a registered personal Photodex account. Account holders must be at least 18.

Album means a collection of Photos, descriptions, labels, memberships and settings controlled by its Owner. An Album is private unless access is given through an invitation or an active Public Link.

Album Member means a person invited to an Album whose access is governed by the permissions the Owner grants. A pending invitation alone does not make its recipient an active member.

Content means Photos, album titles and descriptions, labels, messages, names and other material supplied through the Service. Photo includes an uploaded original and its displayed versions; references to originals do not imply that every viewer may download them.

Owner means the Account holder who owns and controls an Album within the Service. Ownership of an Album does not transfer copyright in a Photo uploaded by another person.

Public Link means an Owner-authorised link through which a person with the link can view an Album without an Account while the link remains active and unexpired. It may permit downloads if that setting is enabled. A Public Link is not a guarantee that recipients will keep material private.

Permissions means the controls for an Album Member, including viewing, uploading, downloading, labelling, deleting their own material where permitted, inviting others and creating links where enabled. The available controls and the Owner's subscription determine what an individual can do.

Service means the Photodex website and photo-archive functions offered at photodexapp.com and any successor domain or app we identify.

Subscription means the Free, Standard or Premium plan, including a trial where offered. Billing Period means the month or year shown at checkout. The Owner's plan governs limits and features of an Album, including the effect on invited members.

Read-only means existing eligible Content can be viewed and, where permission and the relevant feature allow, downloaded, but uploads and changes that exceed the current plan's entitlements are restricted. A read-only Album does not imply access through a paused Public Link.

We, us and Photodex mean Photodex Ltd, company number [insert], with registered office 124 City Road, London, United Kingdom, EC1V 2NX. You means the person using the Service, including a visitor using a Public Link where relevant.

Working day means Monday to Friday excluding public holidays in England and Wales. A reference to law includes applicable amendments and replacements.
